The recently released 2021 Proposed Medicare Outpatient Prospective Payment System (OPPS) rule proposes deeper Medicare payment cuts to many 340B hospitals that have been subject to the cuts since 2018. CMS released its proposal four days after a federal appeals court ruled that the administration has the authority to impose Medicare drug payment cuts to 340B hospitals. The agency is proposing larger cuts based on recent CMS survey data on hospitals’ drug acquisition costs. CMS also is soliciting comments on an alternative proposal to leave the current level of pay reductions in place.

CMS will accept public comments on the proposed rule through Oct. 5, after which the agency will draft a final rule to take effect Jan. 1, 2021.
