The State of 340B Rebates —Litigation, Policy Developments, & What Lies Ahead

Five pharmaceutical manufacturers continue to push for their ability to unilaterally replace upfront 340B discounts with rebate models that have not been approved by the Health Resources and Services Administration (HRSA). 340B covered entities have voiced strong opposition to these rebate structures, citing concerns about the negative impacts to their organizations and patients. This webinar will provide an in-depth overview of the current state of 340B rebates, covering key legal and policy developments and offering strategic guidance for providers. Topics will include:

• Updates on the ongoing litigation by manufacturers challenging HRSA’s enforcement stance that manufacturers cannot unilaterally implement rebates without authorization from the U.S. Department of Health and Human Services (HHS) Secretary
• Developments from HHS, which is actively considering the rebate issue and has committed to releasing guidance by the end of June-and may act sooner
• Approaching Inflation Reduction Act (IRA) deadlines, which manufacturers argue relate to their push for rebates
• Recommendations for how stakeholders can navigate this complex landscape and engage in advocacy to oppose rebates
