STATEMENT ON U.S. SUPREME COURT ORDER IN 340B MEDICARE CUTS LAWSUIT

WASHINGTON, D.C.— The U.S. Supreme Court announced today that it will review a Court of Appeals decision holding that the Centers for Medicare & Medicaid Services (CMS) had the authority to make payment cuts to many 340B hospitals under Medicare’s outpatient prospective payment system (OPPS). The following statement is attributed to 340B Health President and CEO Maureen Testoni:

“We are pleased that the Supreme Court has agreed to review the appellate court decision, which we believe was legally flawed. We are hopeful that the justices will reverse the lower court decision that upheld these damaging cuts to many 340B hospitals treating patients with low incomes. In the meantime, we continue to urge the Biden administration to change this harmful policy by abandoning the payment cuts for 2022 and beyond.”
